- Employees under a contract of employment
- Self-employed individuals, in which case both personal and business debts are considered
- Individuals who have provided guarantees for loans taken out by others (guarantors)
- Former directors of LTD or LLP companies who are guarantors of the company’s debts
- Farmers
A necessary condition is to have one’s centre of main interests (COMI) in England or Wales.
A member of the board of directors of an LTD or LLP company cannot declare personal bankruptcy. If a director of an LTD company has personal debts and wishes to declare bankruptcy, they must first resign from their position on the board of directors of the company.
